Prior to September 4, 1945, Ethyle Hott and Henry A. Griesbach were husband and wife. On that date they were divorced. The
divorce judgment was entered upon a stipulation that if it be granted plaintiff would accept certain property therein described
in lieu of alimony and as a division of estate. The stipulation provided 'that the defendant (the plaintiff here) does not now and will not make any further claim against
the plaintiff in connection with any and all other property that he may own.' The details of the stipulation were not incorporated
in the divorce judgment but were made a part of the record in the instant action. After the divorce the parties continued
to live together for some time and plaintiff performed certain services for Griesbach. Griesbach died on February 23, 1952.
After his death there was found among his papers a life insurance policy in the sum of $3,000 naming plaintiff as beneficiary.
There were also found series E, United States bonds issued in the names of 'Henry A. Griesbach or Mrs. Ethyle Griesbach' and
others issued in the names of 'Mrs. Ethyle Griesbach or Henry A. Griesbach.' Plaintiff brought two actions against the administratrix
of the estate of Henry A. Griesbach, deceased, in the first of which she demanded judgment requiring the return of the bonds
and for damages for the wrongful detention thereof, and in the second of which she demanded judgment that the administratrix
deliver to her the policy of insurance and that it be adJudged that the insurer pay to her the cash value of the policy.
